What the???
« on: June 17, 2011, 22:03:52 »
So some whack job just tried to jump on my car and insist on looking at my VIN # while I was in MY DRIVE LANE!!!  He had a tow truck with a car in tow and followed me down my drive lane. I stopped when he got out of the truck and he asked if I was Lori something or other and I said no then "asked" if he could look at my VIN #, I said NO.  He then tried to climb on my car to read my VIN #!  I told him to get away from my car.  He then starts threatening me with calling the police.  I said PLEASE DO!  He then starts asking me what I have to hide and why I won't let him look in my car!  He then tried to get in front of my car. I gunned it and drove into my garage and shut the door! My husband and son chased him down and we called police.  Turns out the guy is looking for a red 1999 Chrysler Sebring Convertible to repo!  Mine is a 2001 and has been paid off for YEARS!  I had no idea who this whack job was and was not about to let him in my car!  For all I knew he could have had a gun or knife or something!  When talking to the police I said a person just can't come on MY property and try to get on MY car how is that legal?  He said if they are after a repo they can do that!!!  I said perhaps they should be REQUIRED to make sure it's the right vehicle before they TRESPASS!!!  How can this be ok???  I'm about to POP!    :angry4:

I am positive he can come on the property to repo it, however it clearly is not the car he was to repo... aside from that... at first sign of resistance from you (provided he doesn't already have the car hooked up) he would have to cease and desist all repo actions, It's the job of the police to take it from there... (he in almost all cases can not breach the peace... making you surrender your car while you are in it, or making threats would cross this line.)

Did he state his name or the company he represents? (I have a buddy who owns the larger of the repo services in the area)

His truck had no markings on it and when my husband and son pinned him in he wouldn't tell him the name of the company or his name.  He was the one that first brought up calling the police which I welcomed and told him such.  He had a very cocky attitude and appeared not to take no for an answer.  That's when I really got scared and just gunned it to my garage and shut the door.  The net part that scared me was when Randy and I went back outside to see if he was still there and wait for the police, the guy was leaving!  I thought if he really wanted my car for a legit reason he would have called the police.  then fear set in again.

Hmm I'll check with my buddy and see if he had sent any tows out in that area yesterday.

But either way sounds like you did the right thing... I'm sure it would have been much worse for me and him if it happened here on my property rofl.

I'm sure my night will be long, I doubt I'll be able to sleep.  With the way our crazy world is, unfortunately you never know who you're dealing with or what they might do.  Scared me to death!  My son has his CCW and I have never liked that, however tonight it was a little comfort when chasing this idiot!

Yeah, I could imagine...

I have been after my wife to get her ccw for some time... she has always been resistant on the issue until the other day she was out and her car broke down in a not to bright side of Dayton and she had to wait for me to get up there with the tow. Apparently she had a few guys approach the car to ask if she wanted help; not sure if their intentions were wrong or not but it left a sour taste in her mouth. I think we are going tomorrow to get her signed up for it. Way I look at it is,(and I am sure others will have their views) it's only a tool, and if she never has to use it that is great! but I don't want her to find herself in a situation without adequate protection or chance, if something were to arise especially if it arises near our daughter.

I just know myself and how easily I can get shaken up.  I wouldn't want a gun near me or in my hands.  My luck the offender would get it from me and use it on me!  I think it's just so sad that as a society we even have to consider the ccw topic... I want my Grandchildren to have the "lack" of fear I had when I was growing up.  Broke my heart when my Granddaughter told me they have routine lock down drills every month at school!  Made me so sad that she told me in the same way I would say we have routine monthly fire drills.  Just a part of every day living and very sad to say the least.

Couldn't agree more Micki... I am not very old but I grew up in a place where my parents always left the door open and the house unlocked... I wouldn't trust that for a second now... and I dont think I even live in that bad of an area... it's just things happen and now adays they seem to be more and more frequent... also my parents have lived in there home for over 20+years and never had a single incident but in the last year and a half they have experienced several thefts and break ins in their cars... I had parked one of my trucks at there house for 6 hours one night while I was out fishing and someone broke in and stole all my hunting gear which included a very nice compound bow and crossbow, plus numerous fishing equipment.... The last theft they even took my father's ashtray which just had misc spare change.

Ohio is a "breach of peace" state. If you resist they are required to desist. That was explained to me by a reputable repo man.

If we were called the only thing we do is "keep the peace". Repo's are a civil matter. We cannot force the owner to give up the vehicle.

If the repo man came on the wrong property and harassed the wrong person isn't that classified as trespassing ?

Ken, I'm thinking the same thing!  Gary, he "threatened" to call the police, which I told him please do!  At that point I was scared enough to want them there NOW!.  Wouldn't it have made more sense for him to back off and call the police then it would have been straightened out peacefully and I wouldn't have felt so threatened and violated.  By the way shelby County sheriff Deuty was WONDERFUL!  Very kind and understanding.  Never made me feel like this was a waster of him time!  Piqua police NOT SO!!!  To be honest, the piqua officer was quite the jerk!  Makes me appreciate you all the more Gary!  :)

Who was it, Micki?

Yes, the repo should have backed off and called us. We could verified Micki's identity for him. Very, very unprofessional and will probably get him hurt someday.

I've had the same issue with Local law enforcement. UNTIL I moved to centerville. I had ALWAYS called the Sheriff when I needed assistance. It just seems the Sheriff was more efficient and better trained. I have to say though I really like the Centerville police force. Very nice and great to work with. They always stop and talk with the kids and us when we are outside. Just a really good force.

Gary, I think his name was Doge or something like that?  Works the night shift.  when you see him tell him how appreciative I am!

I thought he was going to get hurt last night!  You know how my son can be...  He was to Momma's rescue like lightning!  :D
