Oh Mr Policeman
« on: November 07, 2007, 18:19:58 »
Hey Gary,

Did Ohio change the rule on marked police cars being the only ones able to pull people over?  I've seen 3 sheriff cars and 2 silver Impalas that had people pulled over.  None of the cars had a light bar on the roof and the Impalas had no markings at all.  Just blue and red lights in the grill and back window.  At least the sheriff cars had stickers and sheriff license plates.

Not to answer for Gary but to the best of my knowledge in Ohio a law enforcement vehicle must be marked with emergency lights on top, if one of the primary duties of the unit is traffic enforcement.  I don't see how the silver impala's could have made a  traffic stop without having any markings, Where I work the higher up's drive unmarked Crown Vic's but they have lights on the dash.  (and they can run code lights and sirens to calls) I have never heard of them making a traffic stop, so my guess is maybe the Impala's you seen were police officers who had  stopped to help a stranded motorist.

I'll look it up, but for the most part Rider is correct. A unit running traffic must be marked, although I'm not sure if it's required to have a light on top or whether just a light is sufficient.

I'm not finding anything tonight. I'll ask my Sgt tomorrow and get back with you.

i like the police....we need more....just less doing pointless traffic duty.  i think that is the least of societies worries in this day and age.

like someone needs to arrest the druggie down the street from me.

There are a lot of druggies, sex offenders etc. around that I'm sure the cops would love to get their hands on.  Problem is we (the neighbors etc.) know they are doing it but they do it in such a way that they don't get caught!  Very frustrating.

One of my fellow officers got his thumb kicked over when he was trying to apprehend a crackhead who was standing in the middle of a major roadway. This officer immediately went to the hospital after securing the offender.  The officer had surgery on his finger and later returned to work although his finger still hurt on a daily basis.  It took this officer another year and a half to get the second surgery the doctors recommended but at the same time we had a non convicted murderer in our jail who had two surgeries within six months on his finger that he shot off while murdering a man, and to top things off the now convicted murderer was receiving physical therapy on his finger 2-3 times a week for 3 hours. Sometimes I wonder who stupid us the working class or these people who live off the government (or 1/3 of my paycheck)  :'(     For the murderer I seen several hospital bills over 10k and guess who pays them  :o .  The only good thing about this is the guys has 25+ years to pay us back, well if you want to get technical I believe that also cost the taxpayers $48,000 a year to incarcerate someone.

I found the answer to the original post:

4549.13 Marking and equipment for motor vehicle used by traffic enforcement officers.

Any motor vehicle used by a member of the state highway patrol or by any other peace officer, while said officer is on duty for the exclusive or main purpose of enforcing the motor vehicle or traffic laws of this state, provided the offense is punishable as a misdemeanor, shall be marked in some distinctive manner or color and shall be equipped with, but need not necessarily have in operation at all times, at least one flashing, oscillating, or rotating colored light mounted outside on top of the vehicle. The superintendent of the state highway patrol shall specify what constitutes such a distinctive marking or color for the state highway patrol.

I got to wondering that as well after I posted it. You'd better have a really good reason if the person challenges the stop in court. If the stop gets thrown out so does everything after that. "Fruits of the poisonous tree" as my Constitutional Issues prof used to always tell us.
